Website provision and hosting

The website is technically provided using infrastructure of STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. Domain and website administration is carried out by an external technical service provider. The required data protection agreements are in place with the service providers used.

When the website is accessed, technically required access data is processed. This may include the IP address, date and time of access, requested URL or file, HTTP status code, amount of data transferred, referrer URL and browser and device information.

The processing is necessary to provide the website securely, reliably and in a technically stable manner and to prevent and investigate attacks. The legal basis is Article 6(1)(f) GDPR. The legitimate interest lies in the secure and reliable provision of this website.

Visitor log files are generally retained for no more than seven days. Individual log data may be retained for longer only where this is necessary to investigate a specific security incident or to establish, exercise or defend legal claims.

Cookies, tracking and embedded content

NITSCHE.LEGAL does not use analytics, marketing or profiling cookies on this website. No web analytics or advertising pixels are used, no external social-media content is embedded and no user profiles are created.

The language selection is controlled through the URL and is not stored permanently on the user’s device. A consent banner is therefore not used.

Contact by email and telephone

When you contact NITSCHE.LEGAL, the information you provide is processed, in particular your name, contact details, the content and time of the communication and any documents submitted voluntarily. The processing is carried out to deal with the enquiry, perform a potential conflict check and, where applicable, take steps towards or perform an engagement.

The legal basis is Article 6(1)(b) GDPR where the enquiry concerns pre-contractual measures or an engagement. Otherwise, processing is based on Article 6(1)(f) GDPR; the legitimate interests are the appropriate handling and documentation of the enquiry and the establishment, exercise or defence of legal claims. Where a statutory obligation applies, processing is based on Article 6(1)(c) GDPR.

For an initial enquiry, a brief outline is sufficient. Sensitive or extensive documents should only be provided after coordination and a conflict check.

Microsoft 365

Microsoft 365 is used for email communications. The provider for European customers is, in particular, Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland. Microsoft processes data under contractual data protection terms and has established an EU Data Boundary for Microsoft 365. In limited documented cases, access to or transfers of data outside the European Union or the European Economic Area may occur. Such transfers are made in accordance with Articles 44 et seq. GDPR, in particular on the basis of appropriate safeguards.

This website contains links to external services, in particular to Christina Nitsche’s LinkedIn profile. Until you click such a link, NITSCHE.LEGAL does not transfer data to the relevant provider. Once clicked, you leave this website and the relevant provider is responsible for the subsequent processing.

Recipients, international transfers and retention

Within the purposes described above, personal data may be disclosed in particular to hosting and technical service providers, Microsoft as communications provider, advisers subject to professional confidentiality, authorities or courts where this is necessary or required by law. Personal data is not sold.

Transfers to countries outside the European Union or the European Economic Area are made only where the requirements of Articles 44 et seq. GDPR are met, in particular on the basis of an adequacy decision or appropriate safeguards such as the European Commission’s standard contractual clauses.

Data from contact enquiries is deleted once it is no longer required to deal with the enquiry and any resulting matters, unless statutory retention obligations or overriding legitimate interests require continued storage. If an engagement is established, the applicable engagement-related retention and documentation duties also apply. Data relating to enquiries that are not accepted may be retained to the extent necessary to document the conflict check and defend against legal claims.

Your rights

Subject to the statutory requirements, you have in particular the right of access under Article 15 GDPR, rectification under Article 16 GDPR, erasure under Article 17 GDPR, restriction of processing under Article 18 GDPR, data portability under Article 20 GDPR and objection under Article 21 GDPR. Consent may be withdrawn at any time with effect for the future under Article 7(3) GDPR.
